IEBC Enforcement Committee Hears Case Against UDA Secretary-General Hassan Omar Over Alleged Breach of the Electoral Code of Conduct

As a member of the IEBC Electoral Code of Conduct Enforcement Committee, I joined my colleagues on 21 October 2026 at Anniversary Towers for a hearing chaired by Commissioner Dr. Alutalala Mukhwana, tasked with upholding the integrity of Kenya's Electoral Code of Conduct.

The case arises from remarks UDA Secretary-General Mr. Omar is alleged to have made during a public rally in Mombasa County on 11 September 2026, in which he reportedly claimed that deceased persons had cast votes. The Commission considers such assertions a matter of serious concern, given their potential to undermine public confidence in the integrity of the electoral register and the wider electoral process.

In the course of the hearing, the Committee read the statement of breach to the respondent and afforded him, through his legal representatives, a full opportunity to present his defense. In keeping with the principles of fairness and due process, the Committee will now weigh the evidence and the representations made before it before arriving at a determination in accordance with the applicable legal framework.

The Electoral Code of Conduct sets out the standards expected of political parties, candidates and other electoral participants. It promotes responsible conduct and respect for the rules that govern fair electoral competition. Rigorous and even-handed enforcement of the Code is essential to ensuring that all political activity is carried out in accordance with the Constitution, the Elections Act and other applicable laws.

As preparations for the 2027 General Election gather pace, the Commission reaffirms its unwavering commitment to the rule of law, to the impartial enforcement of electoral regulations, and to the promotion of a peaceful, transparent and credible electoral environment.

The Commission remains resolute in ensuring that every electoral participant upholds the standards prescribed by law safeguarding the integrity of the process and strengthening public confidence as Kenya moves towards its next General Election.
